Data Protection Commitment

• Every form, spreadsheet, and dashboard meets the eight data protection conditions of POPIA by design, not by retrofit
• Client data is handled in accordance with the eight conditions: accountability, processing limitation, purpose specification, further processing limitation, information quality, openness, security safeguards, and data subject participation
• Data collection forms include mandatory consent notices and access logs
• Data minimisation is applied: only information strictly necessary for the specified purpose is collected
• Data is retained for the minimum period required by law or the specific engagement terms
• Audit logs are available on request for all data processing activities during an engagement
• Client retains full ownership of all submitted materials, supporting documentation, and data at project close

Liability Acceptance

UH035 accepts liability for any data breach caused by Lungelo Shandu’s actions or omissions during an engagement. This includes unauthorised access, accidental disclosure, or failure to follow agreed POPIA protocols.

Liability is limited to the total value of the specific engagement unless gross negligence is proven.

This liability does not cover breaches caused by the client’s own staff or other service providers. For the work Lungelo touches, UH035 stands accountable.

Professional Indemnity Insurance

Professional indemnity insurance is held and maintained by UH035. Audit logs and insurance documentation are available on request during the scoping phase of any engagement.

UH035 Does Not Guarantee Funding Approval

• Funder decisions depend on strict eligibility criteria outside Lungelo’s control
• UH035 aligns every application to official SETA and National Treasury guidelines
• Client retains full ownership of all submitted materials and supporting documentation
• POPIA compliance extends to all funder data submissions and third-party portals
• UH035 provides a clear audit trail of every submission and correspondence
• UH035 does not receive commission from funders unless explicitly agreed in writing
• The fee is for preparation and submission support only
• UH035 discloses any potential conflict of interest before engagement begins
• All funding advice is documented in writing and shared with the client for review before submission

Remote Delivery (Standard)

SOP drafting, form automation, dashboard builds, grant applications, research design, and most admin support are delivered remotely.

On-Site Work (By Arrangement)

• Available for staff training handovers, on-site process observation, or stakeholder workshops
• Travel billed at R2.50 per kilometre from Lungelo’s base to the client location and back
• Travel time charged at the standard hourly rate (R300 to R350)
• On-site arrangement agreed in writing before any engagement begins

Payment Terms

• All prices exclude VAT
• Project fees: 50% upfront, 50% on delivery
• Retainers: invoiced monthly in advance
• Additional hours beyond retainer: billed at standard hourly rate (R300 to R350)
• Negotiation is open for first-time clients and non-profits

File Ownership & Handover

Client keeps ownership of every file produced. At project close, UH035 hands back a labelled folder structure with version-controlled files. No proprietary lock-in. All deliverables are built to run on standard devices using standard software (Google Sheets, WordPress, shared hosting).

Commercial Operations (UH035)

Consulting fees fund hosting, software, professional development, and labour for client engagements. No hidden markups.

Social Impact Operations (ak035)

The free career platform runs at R3,495 per month, funded by AdSense revenue, retail margins, and voluntary donations. Commercial engagement does not subsidise ak035. If you value ESG or CSI alignment, purchasing through retail redirects or making a voluntary donation helps keep career tools free for unemployed youth.
